Last Will and Testament

will.jpg (188493 bytes)   Franz wrote his will on the18th of May, 1996, while he was staying in hospital in Luxembourg city. It is an "olographic" will, being completely hand written, signed and bearing the date. This form of will does not need to be certified by a notary, or in any other way witnessed, allowing a person to make their will with complete discretion.

On his return from hospital, Franz placed the will in a cupboard on the second floor of his house, along with all his other important documents. It remained there for five years until his death. Though many people advised him during his life to set his affairs in order, and make a will, not once did he reveal that he had in fact already done so.

  Last Will and Testament

Durch dieses Testament bestimmt der Unterzeichnete François Antoine Urbany geboren am 28. Mai 1929 in Esch an der Alzette, folgendes:

  Through this will, the undersigned François Antoine Urbany born on 28th May 1929 in Esch/Alzette declares as follows:

1. Die Nachkommen der verstorbenen Eheleute Nicolas Bourone-Urbany sind von jeder Erbschaft ausgeschlossen.

1. The descendants of the deceased couple Nicolas Bourone-Urbany are excluded from all inheritance.

2. Mein Vetter Fernand Urbany erhält 200 000 (zwei hundert tausend) LUF in bar plus die Erbschaftssteuer.

2. My cousin Fernand Urbany shall receive 200,000 (two hundred thousand) Luxembourg Francs in cash plus the inheritance tax.

3. Marco Sand, Sohn der Eheleute Sand-Wecker, erhält das Nutzniessungsrecht auf dem ganzen Hause gelegen in Esch/Alzette, Spitalstrasse 45. Zeit seines Lebens kann er darin wohnen oder es vermieten, unter der Bedingung dass er die notwendigen Reparaturen ausführen lässt.

3. Marco Sand, son of the couple Sand-Wecker, receives the right of abode for the whole of the house situated in Esch/Alzette, Hospital Street 45. During his lifetime, he can live in it or let it out, on the condition that he undertakes all necessary repairs.

4. Das Haus gelegen zu Esch/Alzette Origerstrasse 11 soll zu Museumszwecken erhalten bleiben mit dem gesamten dazu gehörenden Mobiliar. Eigentümer wird diejenige Verwaltung, Vereinigung oder Stiftung werden, welche diesem Zweck am besten entspricht.

4. The house situated Origer Street 11 is to be preserved as a museum with the entire furniture. Ownership shall pass to the administration, association or foundation that can best fulfil this purpose.

5. Meine Sand-und Steingrube zu Beckerich würde sich vorzüglich für praktische Übungen des sekundären und postsekundären Unterrichtes in den Fächern Bergbau, Geologie, Mineralogie, Mikroskopie, Goniometrie, Chemie, Physik usw. eignen. Als Besitzer käme dann das Erziehungsministerium in Frage, oder eine entsprechende interregionale Vereinigung.

5. My sand and stone pit in Beckerich would be suitable for practical field work for secondary or post secondary education in the subjects of mining, geology, minerology, microscopy, goniometry, chemistry physics etc. The Ministry of Education or an equivalent interregional association could be considered as potential owners.

6. Alle Grubenmaschinen, sowie alles Handwerkzeug gehört den Vereinigungen “Entente Site Cockerill” und A.H.I. während meine Bücher Eigentum der Vereinigung C.D.S werden.

6. All mining equipment, as well as any tools shall belong to the association “Entente Site Cockerill” and A.H.I. whereas my books will become the property of the association C.D.S.

7. Das Restvermögen, nach Abzug aller Unkosten, teilen sich zur Hälfte die Eheleute David Greenwood-Hamilius, wohnhaft zu Esch/Alzette, rue du Faubourg unter der Bedingung dass sie mein Grab pflegen, sowie die übrigen legalen Erben mütterlicherseits.

7. The remaining wealth, after deduction of all costs, shall be divided; one half shall go to the couple David Greenwood-Hamilius, from Esch/Alzette, rue du Faubourg on the condition that they care for my grave, and the other half shall be divided equally between the remaining legal inheritors on my mother’s side.
